EU GMP Annex 19 repackaging samples need operation-level evidence

The European Commission's revised Annex 19 becomes applicable on September 24, 2026. Its parallel-import, distribution, and trade section distinguishes packaging-material samples from one retention sample of each re-packaged finished-product operation, and allows a photographic or digital substitute only under a justified advance agreement with the competent authority. A digital image is not a default waiver of a physical sample.

Map the sample duty to each re-packaging operation

The direct answer is to inventory re-packaged finished-product operations and their sample evidence before the revised Annex 19 becomes applicable on September 24, 2026. The Commission published the revision June 24. Section 9 addresses parallel imported, parallel distributed, and parallel traded products. It says to keep physical samples of packaging materials used in re-packaging for the shelf life of the re-packaged product and a retention sample of the finished re-packaged product for each re-packaging operation for at least one year after expiry. Those are different objects with different scope and retention clocks.

A program should identify product, market, marketing-authorization and re-packaging context, batch, original and re-packaging site, operation identifier and date, primary and secondary packaging, labels, carton and leaflet versions, expiry, sample location, custodian, access, and disposition. Do not equate one retained example of a product family with evidence for every operation. Section 9.2 says a reference sample of the re-packaged product is not required; that does not cancel the separate packaging-material and retention-sample expectations. Apply the exact annex and relevant national or product-specific requirements with qualified regulatory review.

A digital substitute is a narrow, pre-agreed exception

Section 9.5 does not make a photograph the routine replacement for a physical retention sample. It describes a duly justified situation in which physical retention cannot reasonably be done and the competent authority has agreed in advance. The exception record should preserve the reason, affected operation and product, the request, authority response and conditions, effective date, approved capture method, reviewer, and the link to the batch packaging record. An internal approval or software setting is not the same as advance competent-authority agreement.

Where that exception applies, sections 9.5.1–9.5.4 call for a complete visual record capable of examination and investigation comparable to a physical sample, high-quality images, batch-packaging-record traceability, primary and secondary package details including batch and expiry, safety features and braille identification, and electronic integrity following Annex 11 principles. A single front-of-pack image or a generated product mock-up would not satisfy those stated evidence characteristics. Verify capture coverage, legibility, tamper controls, retrieval, and continued readability over the retention period; the public annex does not validate any particular imaging system.

Keep sample custody separate from batch release

Annex 19 also distinguishes reference samples for later analytical testing from retention samples that show a fully finished product's presentation. The same physical unit can sometimes serve both purposes for a finished product, but the parallel-trade rules in section 9 need to be read specifically. Written arrangements across marketing-authorization holders, importers, manufacturers, packaging sites, and batch-release sites may be necessary to identify who takes, stores, and provides access to relevant samples. Section 6 says the certifying Qualified Person should be able to access relevant samples at reasonable times.

A buyer or quality team should test retrieval after a complaint: select a named re-packaging operation, locate the physical packaging materials and finished-product retention sample or the pre-agreed digital substitute, verify label and leaflet versions, reconcile the batch packaging record, and show who had custody throughout. The sample trail supports later investigation and inspection; it is not itself a batch certification, evidence that the batch met all GMP requirements, or a marketing authorization. Likewise, a QMS record marked complete cannot replace an actual retrievable sample or qualified exception.

Status, limits, and next check

This analysis uses the European Commission's June 24 revised Annex 19 PDF and publication notice reviewed September 22, 2026. The Commission identifies application on September 24; this article does not state the revised text was already applicable on the review date. We did not inspect a product, packaging operation, authority agreement, sample, image, batch record, storage site, QP certification, or inspection result. The annex is GMP guidance within the stated EU framework, not a vendor certification or a substitute for the governing legal and national requirements.

The immediate priority is an operation-by-operation gap review: which currently distributed re-packaged products will be in scope on the application date, where each required physical sample is stored, what exceptions exist, and whether any digital substitute has a justified advance authority agreement and the complete visual and integrity record. Preserve the previous procedure and samples when updating controls, because later investigators may need to reconstruct which version governed an earlier operation. Confirm the Commission's live EudraLex index and competent-authority instructions before making a product-specific decision.

Enterprise buyer test

Translate this change into the exact population, record type, workflow stage, decision owner, effective date, and evidence that could be affected. Ask current or prospective providers to demonstrate the named workflow with representative data and an exception—not a polished feature tour. Record what official documentation establishes, what a provider states, what the team observes, and what remains unresolved.

A defensible review also identifies the dependency outside the product. Authority interpretation, policy configuration, data quality, integrations, human judgment, approval rights, release governance, training, and retained evidence may remain customer or service responsibilities. The evaluation should preserve those boundaries instead of treating a technology claim as the complete operating model.

What we will watch next

RegQuality Review will watch the named source and affected market records for later evidence that changes status, scope, availability, implementation timing, workflow consequence, or the limits of the initial report. A later announcement does not silently overwrite this dated account; the change ledger preserves the sequence.
